Key Provisions

• Blocks licensed firearm sellers from selling guns to people convicted of certain misdemeanor hate crimes.
• Prevents people convicted of certain misdemeanor hate crimes from owning, shipping, or transporting firearms.
• Defines a "misdemeanor hate crime" as a less serious offense motivated by hate or bias against someone's race, color, religion, national origin, gender, sexual orientation, gender identity, or disability, involving force or threats.
• Defines an "enhanced hate crime misdemeanor sentence" as a tougher sentence for a hate-motivated misdemeanor involving force or threats.
• Ensures these prohibitions would not apply if the conviction was cleared or pardoned, or if the person did not have legal representation or a jury trial (unless waived).
